Terms of Service

These Terms of Service (“Terms”) govern your use of PrepEM (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The service
PrepEM is an online study and practice tool to help physicians and trainees prepare for the ABEM Certifying Exam, including timed practice cases, AI-powered standardized-patient encounters, quizzes, and reference material.
2. Not affiliated; not medical advice
PrepEM is an independent product and is not affiliated with or endorsed by the American Board of Emergency Medicine (ABEM) or the American College of Emergency Physicians (ACEP). All content is provided for educational and exam-preparation purposes only. It is not medical advice and must not be used to diagnose or treat any patient or to make clinical decisions.
3. Artificial intelligence disclosure
Some features of the Service use artificial intelligence. When you use the AI standardized-patient encounters — whether the simulated counterpart is a patient, a family member, or another clinician — you are interacting with an automated AI system — not a real person or a licensed clinician. The simulated counterpart's messages and the end-of-case feedback are generated by AI, may be incomplete or incorrect, and are provided solely for exam practice. This notice is provided so that your interaction with AI is clear and conspicuous. Encounter transcripts are stored and may be reviewed to evaluate and improve the Service, as described in our Privacy Policy.
4. No guarantee of results or accuracy
We strive for accurate, up-to-date content, but we do not warrant that the material is complete, current, or error-free, and we do not guarantee any particular exam outcome. AI-generated output, as described above, is for exam practice only and may be incomplete or incorrect. Always verify clinical information against authoritative primary sources.
5. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it updated. You must be at least 18 years old to create an account.
6. Acceptable use
You agree not to:
- Share, resell, or sublicense your account or access to the Service.
- Copy, scrape, redistribute, or create derivative works from our content.
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
- Use the Service for any unlawful purpose.
- Enter real, identifiable patient information or other protected health information (PHI) into any feature — including voice dictation and the AI standardized-patient encounters. These features are for your own exam-practice answers only, using fictional case material.
7. Intellectual property
The Service and its content are owned by PrepEM and protected by applicable laws. We grant you a limited, personal, non-transferable, non-commercial license to use the Service for your own exam preparation. All rights not expressly granted are reserved.
8. Third-party services
The Service relies on third-party providers (including Google, Supabase, Vercel, Resend, and OpenAI — which powers voice-dictation transcription as well as the AI standardized-patient encounters and their automated feedback) to operate. Your use of those services through PrepEM may also be subject to their respective terms.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, PrepEM and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or inability to use, the Service.
11. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms. You may stop using the Service and request account deletion at any time.
12. Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
